باستخدامك لهذا الموقع أو شرائك لأي من خدماته، فإنك توافق على هذه الشروط والأحكام وعلى السياسات المرتبطة بها، وتشكل هذه الاتفاقية التزاماً قانونياً كاملاً بينك وبين IMPERIUM GROUP – F.Z.E المسجَّلة قانونياً في دولة
الإمارات العربية المتحدة.
1. القبول والاتفاقية الملزمة
مرحباً بك في PLSTOP.COM، وهو موقع تديره IMPERIUM GROUP – F.Z.E (“الشركة”، “نحن”).
من خلال استخدامك لهذا الموقع أو شرائك لخدماتنا، فإنك تؤكد أنك قرأت وفهمت وتوافق على الالتزام الكامل بهذه الشروط والأحكام (“الشروط”) بالإضافة إلى سياسة الخصوصية وسياسة الاستخدام المقبول، وجميعها تُعد جزءاً لا يتجزأ من هذه الاتفاقية.
2. وصف الخدمات ونطاقها
2.1 نطاق الخدمة:
تقدم الشركة خدمات احترافية في إدارة وصيانة المواقع الإلكترونية، وتشمل على سبيل المثال لا الحصر: الصيانة الدورية، النسخ الاحتياطي، الحماية والمراقبة الأمنية، وتحسين الأداء، وفقاً لنوع الاشتراك المحدد من قِبلك.
2.2 استثناءات الخدمة:
لا تشمل خدماتنا: استضافة الويب، تسجيل النطاقات، تصميم أو تطوير المواقع من البداية، أو التسويق الإلكتروني. ويتحمل العميل مسؤولية التعاقد مع مزودي خدمات آخرين لأي من هذه الأغراض.
3. التزامات العميل
3.1 المعلومات الدقيقة:
يتعهد العميل بأن جميع المعلومات المقدمة للشركة (بما في ذلك معلومات الاتصال والدفع) دقيقة ومحدّثة وصحيحة بالكامل.
3.2 الوصول الآمن:
يوافق العميل على تزويد الشركة ببيانات الوصول الإدارية اللازمة لتنفيذ الخدمات، ويتحمل وحده مسؤولية الحفاظ على سرية هذه البيانات.
3.3 المسؤولية القانونية عن المحتوى:
يُعتبر العميل المسؤول الوحيد عن محتوى موقعه الإلكتروني، ويضمن توافقه مع القوانين المعمول بها في دولة الإمارات العربية المتحدة وعدم انتهاكه لحقوق أي طرف ثالث.
4. المدفوعات، التجديد والإلغاء
4.1 الفوترة المتكررة:
تُقدَّم الخدمات على أساس اشتراك يتم تجديده تلقائياً شهرياً أو سنوياً. وبموافقتك، فإنك تفوّضنا بخصم رسوم الاشتراك من وسيلة الدفع المسجَّلة عند كل دورة فوترة.
4.2 التجديد التلقائي:
يتم تجديد الاشتراك تلقائياً لتفادي انقطاع الخدمة، ما لم يقم العميل بإلغائه قبل تاريخ التجديد.
4.3 الإلغاء:
يمكن إلغاء الاشتراك في أي وقت، ويُفعّل الإلغاء في نهاية فترة الفوترة الحالية. تبقى الخدمة نشطة حتى ذلك التاريخ دون إصدار فواتير إضافية.
4.4 سياسة الاسترداد:
تخضع طلبات استرداد الأموال لشروط سياسة استرداد الأموال المنشورة على الموقع.
5. حقوق المستهلكين في الاتحاد الأوروبي
5.1 الاعتراف بالحقوق:
على الرغم من أن القانون الحاكم هو قانون دولة الإمارات العربية المتحدة، إلا أننا نعترف بحقوق المستهلك الإلزامية للمقيمين في الاتحاد الأوروبي.
5.2 التنازل عن حق الانسحاب:
تُعتبر خدماتنا محتوى رقمياً يبدأ تقديمه فوراً بعد الطلب، وبالتالي:
(أ) يوافق العميل على البدء الفوري في تنفيذ الخدمة قبل انتهاء فترة الانسحاب القانونية (14 يوماً).
(ب) يدرك أنه بفقدان حق الانسحاب بعد بدء تقديم الخدمة لا يمكنه المطالبة باسترداد المبلغ على هذا الأساس.
6. حدود المسؤولية وإخلاء المسؤولية
6.1 طبيعة الخدمة:
تُقدَّم الخدمات على أساس “كما هي” و”حسب التوفر”. تبذل الشركة أقصى جهدها لضمان الجودة والأمان، لكنها لا تضمن خلو الخدمات من الأخطاء أو التهديدات بالكامل.
6.2 الحد الأقصى للمسؤولية:
تقتصر المسؤولية المالية للشركة، في أي حال، على المبلغ الإجمالي الذي دفعه العميل خلال الثلاثة أشهر السابقة لوقوع المطالبة.
6.3 استبعاد الأضرار غير المباشرة:
لا تتحمل الشركة أي مسؤولية عن الأضرار التبعية أو العرضية أو خسارة الأرباح أو البيانات الناتجة عن استخدام الخدمات.
7. الملكية الفكرية
7.1 حقوق العميل:
يحتفظ العميل بكامل حقوق الملكية الفكرية لمحتوى موقعه.
7.2 حقوق الشركة:
جميع البرمجيات، والأدوات، والتقارير، والعمليات التي تطورها أو تستخدمها IMPERIUM GROUP – F.Z.E لتقديم الخدمات تبقى ملكية فكرية حصرية للشركة.
8. القانون الحاكم وحل النزاعات
8.1 القانون الحاكم:
أي شراء أو نزاع أو مطالبة تنشأ عن أو تتعلق بهذا الموقع تُحكم وتُفسَّر وفقاً لقوانين دولة الإمارات العربية المتحدة.
8.2 الاختصاص القضائي:
تُحال أي نزاعات إلى المحاكم المختصة في دولة الإمارات العربية المتحدة، بما في ذلك محاكم مركز دبي المالي العالمي (DIFC) عند الاقتضاء.
8.3 منصة الاتحاد الأوروبي لحل النزاعات:
للمقيمين في الاتحاد الأوروبي، يمكن تقديم الشكاوى عبر منصة المفوضية الأوروبية لحل النزاعات عبر الإنترنت:

9. سياسات الدفع والامتثال
- يُقبل الدفع ببطاقات Visa وMasterCard الائتمانية والخصم المباشر بالدرهم الإماراتي (AED).
- السعر والعملة المعروضان في صفحة الدفع هما نفس السعر والعملة المطبوعة في إيصال المعاملة، والمبلغ سيظهر في كشف البطاقة بعملة البطاقة نفسها.
- لن تتعامل الشركة أو تقدم خدماتها لأي دولة أو جهة خاضعة للعقوبات الدولية (OFAC أو غيرها).
- يحظر على القاصرين (دون سن 18 سنة) التسجيل أو إجراء المعاملات على الموقع.
- يجب على حامل البطاقة الاحتفاظ بنسخة من سجلات المعاملات والسياسات والقواعد المنشورة على موقع https://plstop.com/.
- المستخدم مسؤول عن الحفاظ على سرية حسابه وعدم مشاركته مع أي طرف آخر.
10. أحكام عامة
10.1 التعديلات:
تحتفظ الشركة بحق تعديل هذه الشروط والسياسات في أي وقت. استمرار استخدامك للموقع بعد نشر التحديث يُعتبر قبولاً بها.
